The Promotion begins on JANUARY 23, 2020 at 12:01 A.M./EST and ends on February 15, 2020 at 11:59 P.M./EST (the “Promotion Period”). Survey responses submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Starbucks Gift Card Giveaway THIS PROMOTION IS GOOD ONLY IN ALL 50 U.S. STATES AND IS SUBJECT TO ALL U.S. FEDERAL, STATE AND LOCAL LAWS, REGULATIONS, AND RULES.
ELIGIBILITY: Starbucks Gift Card Giveaway is open only to legal residents of the United States who (a) are at least eighteen (18) years old and (b) have not won a sweepstakes or contest conducted by Sponsor in the previous ninety (90) days. Employees of Sponsor, Motif, as well as the immediate family (spouse, parents, siblings, children, and any and all “step”, “half”, and “in-law” derivatives of the aforementioned relationships) and household members of those employees, are not eligible to enter. Household members shall mean people who share the same residence at least three months a year.
HOW TO ENTER: To participate in the Promotion, eligible persons may enter the Promotion from JANUARY 23, 2020/12:01 A.M./EST and ends on FEBRUARY 15, 2020 at 11:59:01 P.M. EST. Fill out the survey and provide requested information. There is a limit of one (1) prize per household. The use of any agency, program, bot, application, device, or any automated system to enter is strictly prohibited, and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion. All entries become the exclusive property of the Sponsor. Entries in excess of the allowed maximum, by any means will be disqualified. A registered account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Participant may be required to submit proof that he or she is the registered account holder. Normal Internet/mobile access and device usage charges imposed by your service provider will apply. Sponsor cannot guarantee this Promotion will be available via all wireless carriers.
WINNER SELECTION: On or after FEBRUARY 17, 2020 11:59:01 P.M. EST, Sponsor will select fifty (50) potential winners. The winners will be the first 50 entrants who complete the survey. NO PARTICIPANT IS A WINNER OF ANY PRIZE UNTIL THE PARTICIPANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND THE PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
PRIZES AND THE AWARDING OF PRIZES: PRIZE. The approximate value of the individual prize is $5.00. Maximum total ARV (actual reward value) of all prizes: $5.00. No substitution, exchange, or transfer of prize by any winner. Sponsor reserves the right to substitute any prize for one of equal or greater value. Limit: 1 Sweepstakes prize per person.
REQUIREMENTS OF POTENTIAL WINNERS: Winners must comply with these Official Rules and winning is contingent upon fulfilling all requirements. Sponsor will attempt to notify potential winner(s) within two (2) business days of the drawing by contacting the potential winner(s) at the email address used to enter. If a potential winner does not respond within one (2) business days after Sponsor replies, or as directed by Sponsor, an alternate potential winner may be selected in his/her place. Only three (3) alternate potential winners may be contacted. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility, liability/publicity release, and an agreement to allow use of his/her name, city and state of residence, photograph, likeness, and/or voice in publicity or advertising concerning this promotion and the Sponsor without compensation except in states where prohibited in order to claim his/her prize. In the event the selected winner is an individual under the age of majority in their state of residence, their parent or legal guardian will be required to provide such authorizations. If there is no response or a potential winner fails to sign and return the affidavit of eligibility and/or where applicable, the liability/publicity release within the required time period, the potential winner will be disqualified and an alternate potential winner may be selected in his/her place. Only three (3) alternate potential winners may be contacted. All properly claimed prizes will be awarded. Unclaimed prizes will not be awarded. ODDS: The actual odds of winning a prize will depend on the number of valid and eligible entries received.
GENERAL: Taxes and all other costs and expenses associated with prize receipt and/or use, if any, are the sole responsibility of the winner. Sponsor is not responsible for lost, late, incomplete, stolen, misdirected, mutilated, postage-due, illegible, unreadable, or printed information relating to the Promotion (including typographical errors); any computer, telephone, cable, network, satellite, server, service provider, electronic, power, or Internet or other hardware or software malfunctions, failures, connections, or availability; data loss or late or incorrect data processing; Internet traffic congestion; service provider/Internet/Site inaccessibility, unavailability, or malfunction; garbled or jumbled transmissions; or unauthorized human intervention. All entries become the property of Sponsor and will not be acknowledged or returned. SPONSOR AND EACH OF ITS OFFICERS, DIRECTORS, AFFILIATES, RELATED ENTITIES, PARTNERS, PARTNERSHIPS, PRINCIPALS, REPRESENTATIVES, AGENTS, LICENSEES, SUCCESSORS AND ASSIGNS (I) MAKE NO EXPRESS WARRANTY, GUARANTY, OR REPRESENTATION OF ANY KIND CONCERNING ANY PRIZE, (II) DISCLAIM ANY IMPLIED WARRANTY, AND (III) ARE NOT LIABLE FOR INJURY, LOSS, OR DAMAGE OF ANY KIND RESULTING FROM THE ACCEPTANCE OR USE OF THE PRIZE OR FROM PARTICIPATING IN THIS PROMOTION. ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY. VOID BY LAW WHEREVER PROHIBITED. Sponsor reserves the right to cancel this Promotion at any time without obligation or prior notice. By entering this Promotion, participants agree to be bound by these Official Rules and all decisions of the Sponsor and any judging organizations, which are final on all matters related to the Promotion. In the event that the operation, security, or administration for the Promotion is impaired in any way for any reason, including, but, not limited to, fraud, virus, regularly scheduled maintenance, or other technical problems, the Sponsor may, in its sole discretion, either: (a) modify the Promotion in a manner that best conforms to the spirit of these Official Rules without suspending it; (b) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (c) cancel the Promotion and award the prizes in a random drawing from among all eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of Promotion or to be acting in violation of these Official Rules or from the Promotion or any other promotions by the Sponsor. Any attempt by any person to undermine the legitimate operation of any part of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
RELEASE & LIMITATIONS OF LIABILITY: Participants acknowledge that this Promotion is not a product or service offered by Survey Monkey, is in no way sponsored, endorsed, administered by, or associated with Survey Monday. By participating in the Starbucks Gift Card Giveaway, you agree to release and hold harmless Sponsor, Administrator, Survey Monkey, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Starbucks Gift Card Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Starbucks Gift Card Giveaway; (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Starbucks Gift Card Giveaway or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Starbucks Gift Card Giveaway, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
DISPUTES: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND ILLINOIS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Chicago, Il, having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participants’ actual out-of-pocket expenses (i.e. costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
